Terms of agreement

1. 1. The terms of agreement are applicable on all offers, orders or agreements of Bollekewoldesign/ Van de Velde Els. Agreed exceptions from the terms of agreement do not apply to future transactions.

   2. Accepting an offer or placing an order equals accepting these terms of agreement.

   3. These terms of agreement can only be altered in writing by Van de Velde Els, in which case the remaining articles still apply.

2. Products

   1. Bollekewoldesign/Van de Velde Els will described and display the offered articles on the website and in offers truthfully. However, the displayed articles can differ due to technical circumstances ( f.e. colour specifications of the used computer ).Bollekewoldesign / Van de Velde Els cannot be held liable for these alterations. In case of doubt or further information please contact Bollekewoldesign / Van de Velde Els.

3. Prices

   1. All prices mentioned on the website are displayed in euro, VAT included and shipping costs excluded.

   2. Bollekewoldesign / Van de Velde Els cannot be held liable to prices, which reasonably have to be considered miswritten.

   3. Changes in pricing are effective immediately as soon as they are published on the website.

4. 1. All offers of Bollekewoldesign/Van de Velde Els are free of obligations.

5. Orders and methods of payment

   1. An agreement is established after acceptation of Bollekewoldesign/Van de Velde Els by means of e-mail. Bollekewoldesign/Van de Velde Els can always choose to process the order later or to cancel it. The consumer will be informed by Bollekewoldesign/Van de Velde Els in writing within 3 working days.

   2. Methods of payment.

      1. Belgium: payment in advance by Bank transfer of Bancontact/Mister Cash.

      2. Other countries: payment in advance by Bank transfer or IDEAL payment.

   3. Bollekewoldesign/ Van de Velde Els will process the order after payment is confirmed.

   4. The consumer will receive an e-mail of confirmation after the payment. The total sum mentioned in the e-mail includes the VAT and shipping costs.

6. Delivery

   1. Bollekewoldesign/Van de Velde Els strives to deliver as soon as possible after the payment is received. For Belgium supposably within three working days, for international shipments within five working days.

   2. The delivery date for handmade pieces is 2 till 6 weeks, depending on the current orders.

   3. For more detailed information regarding the delivery date, please contact Bollekewoldesign/Van de Velde by e-mail or telephone.

   4. In case the delivery is delayed, not processed or partially carried out, the consumer will be informed by e-mail or telephone.

   5. Strikes of GLS or Bpost cannot lead to the liability of Bollekewoldesign/Van de Velde Els.Public Belgian holidays are excluded from the delivery date.

7. Shipping

   1. Bollekewoldesign/ Van de Velde Els will use Bpost  for the shipment of the articles.

   2. Bollekewoldesign/Van de Velde Els cannot be held liable when  Bpost misplaces the articles.

   3. Bollekewoldesign/Van de Velde Els is not liable for wrong or delayed deliveries due to incorrect or incomplete address information.

   4. Shipping costs:

      1. Belgium: orders up to 100 euro shipping cost 7.26 euro. Free shipping costs for orders above €100.

      2. Nederland , Frankrijk, Duitsland: orders up to €150: €11.50 shipping costs. Free shipping costs for orders above €150.

      3. All other countries: on demand. Shipping costs depends on the weight of the order.

8. Returning goods

   1. If the consumer is unsatisfied with the purchase, the consumer will be able to return the goods within 7 working days after receipt of the purchase.

      1. During these 7 working days the consumer will only open the package so he/she can Judge whether or not the purchase is according to their wishes. If the consumer wishes to return the goods, the articles must be as much as possible in the original packaging and be returned to Bollekewoldesign/Van de Velde Els

      2. The shipping costs for returning the goods will be covered by the consumer and not by Bollekewoldesing/Van de Velde Els unless it was agreed otherwise between the consumer and Bollekewoldesign/Van de Velde Els. If the shipping costs for returning the goods would be less than the original shipping costs, the rest of the amount will be accounted and must be paid by the consumer.

   2. The consumer can only return the purchase if the articles:

      1. are undamaged

      2. are foreseen with the original label and packagings.

      3. are unused and in the original state

      4. Cannot contain any odd scents (f.e. Perfume, cigarettes, food smell)

   3. The purchase will be refunded if the returned articles are delivered to Bollekewoldesign/Van de Velde Els within 14 working days after being delivered to the consumer.

   4. The following purchases are non-refundable:  

      1. Articles that can easily be copied such as PDF files of patters or books

      2. Sales

      3. Tailor made pieces

   5. Bollekewoldesign/Van de Velde Els has the right to refuse or partially accept the returned articles if one of the above standards isn’t fulfilled.

9. Liability

   1. Bollekewoldesign/Van de Velde Els cannot be held liable for any damage. Neither is Bollekewoldesign/Van de Velde Els liable for any damage caused by a third party.

   2. Bollekewoldesign/Van de Velde Els is not liable for any damage caused by using the products of Bollekewoldesign/Van de Velde Els.

   3. All disputes are subjected to the Belgian law and the jurisdiction lies with the Belgian courts.
